1. Introduction and Acceptance
These Terms and Conditions govern your use of the Dewfall website and the residency services provided by Dewfall, located at 77/2 Thanon Khao Noi, Mueang Songkhla, Songkhla 90000, Thailand.
By using our website, inquiring about services, visiting our facility, or entering into a residency agreement, you accept and agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our website or services.
These terms should be read in conjunction with our Privacy Policy and Cookie Policy, which form part of this agreement.
2. Definitions
In these Terms and Conditions:
- "We," "Us," "Our" refers to Dewfall
- "You," "Your" refers to the website user, prospective resident, resident, or family member
- "Resident" refers to an individual residing at Dewfall under a residency agreement
- "Services" refers to the residency and care services provided by Dewfall
- "Agreement" refers to the residency agreement entered into between Dewfall and a resident or their legal representative
- "Website" refers to the Dewfall website at deewffalla.info
3. Services Description
Dewfall provides residential care services for elderly individuals, including accommodation, daily meals, personal care assistance, housekeeping, and access to cultural and social activities. We are not a medical facility and do not provide nursing or clinical care services.
Services are provided as described on our website and in individual residency agreements. We reserve the right to modify services with reasonable notice to residents and families, provided such modifications do not materially reduce the quality or scope of core services.
The specific services included in each residency option (Lakeside Room Residency, Heritage & Social Program, or Private Room with Companion) are detailed in the respective residency agreements.
4. Eligibility for Residency
Residency at Dewfall is available to elderly individuals who:
- Are age 60 or older (exceptions may be considered on a case-by-case basis)
- Can manage with daily living assistance rather than requiring continuous medical or nursing care
- Do not have conditions requiring specialized medical equipment or 24-hour medical supervision
- Can participate safely in a communal living environment
We conduct an assessment process to determine suitability for residency. This assessment considers health status, mobility, cognitive function, and personal care needs. We reserve the right to decline residency if we determine that we cannot adequately meet an individual's care requirements.
Prospective residents must provide accurate and complete information during the assessment process. Misrepresentation of health status or care needs may result in termination of residency.
5. Residency Agreements
Residency is formalized through a written agreement between Dewfall and the resident (or their legal representative). The agreement specifies:
- Services to be provided
- Monthly fees and payment terms
- Move-in date and any trial period
- Termination conditions and notice requirements
- Resident responsibilities and facility rules
Both parties must sign the agreement before residency begins. The resident or their legal representative must have the capacity to enter into a binding contract. If the resident lacks capacity, a legally authorized representative must sign on their behalf.
Residency agreements may include an initial trial period (typically 30-90 days) during which either party may terminate with shorter notice.
6. Payment Terms
Monthly Fees: Residency fees are payable monthly in advance. Payment is due on the first day of each month. Late payments may incur additional fees as specified in the residency agreement.
Security Deposit: A security deposit equal to one month's residency fee is required before move-in. This deposit is refundable upon departure, less any amounts owed or deductions for damages beyond normal wear.
Fee Adjustments: We reserve the right to adjust fees annually with 60 days advance written notice. Fee increases will reflect changes in operating costs, inflation, or service enhancements.
Payment Methods: Payments may be made by bank transfer, check, or cash. We do not accept credit card payments for monthly residency fees.
All fees are stated in Thai Baht (฿). Payment must be made in Thai currency.
7. Resident Responsibilities
Residents and their families agree to:
- Provide accurate health information and promptly report changes in health status
- Treat staff, other residents, and visitors with respect and courtesy
- Comply with facility rules regarding safety, noise, and communal living
- Arrange and coordinate external medical care when needed
- Pay all fees on time as specified in the residency agreement
- Maintain adequate personal liability insurance (recommended but not required)
- Notify us of extended absences or family visits
- Keep personal belongings appropriately secured and labeled
8. Our Responsibilities
Dewfall commits to:
- Provide the services specified in the residency agreement
- Maintain a safe, clean, and comfortable living environment
- Respect resident privacy and dignity in all interactions
- Communicate promptly with families regarding resident well-being
- Employ trained staff capable of providing appropriate care and support
- Maintain adequate insurance coverage for the facility
- Address concerns and complaints in a timely and respectful manner
9. Termination of Residency
Termination by Resident or Family
Residents or their legal representatives may terminate residency with 30 days written notice. During the trial period (if applicable), shorter notice may be permitted as specified in the agreement. Fees are prorated for partial months.
Termination by Dewfall
We may terminate residency under the following circumstances:
- Non-payment of fees after reasonable notice and opportunity to cure
- Resident's care needs exceed our capabilities to provide adequate support
- Resident behavior poses a safety risk to themselves, staff, or other residents
- Material breach of residency agreement after notice and opportunity to remedy
- Facility closure or cessation of operations (with maximum advance notice possible)
Except in cases of immediate safety concerns, we will provide 30 days notice of termination and work collaboratively with families to arrange alternative care.
Effect of Termination
Upon termination, all fees must be settled, personal belongings removed, and the room returned in acceptable condition. The security deposit will be refunded within 30 days of departure, less any applicable deductions.
10. Health and Medical Care
Dewfall is not a medical facility. We do not provide medical treatment, nursing care, or administer medications requiring clinical expertise. Our staff can assist with medication reminders and support self-administration of medications as prescribed by physicians.
Residents and families are responsible for arranging all medical care, including physician visits, hospital treatment, and specialist consultations. We will coordinate with healthcare providers and assist with appointments as needed.
In medical emergencies, we will contact emergency services and notify designated family contacts immediately. We may provide basic first aid while awaiting professional medical help.
If a resident develops care needs beyond our capability (such as requiring continuous medical supervision, specialized medical equipment, or advanced dementia care), we will work with families to arrange transfer to an appropriate medical facility.
11. Limitation of Liability
To the fullest extent permitted by Thai law:
Dewfall shall not be liable for indirect, incidental, consequential, or punitive damages arising from residency or use of services. Our total liability for any claim shall not exceed the total fees paid by the resident in the six months preceding the claim.
We are not liable for loss, theft, or damage to residents' personal property. Residents are advised to maintain appropriate insurance for valuable items and to use provided storage facilities for securing belongings.
We are not liable for medical outcomes, health deterioration, or injuries resulting from pre-existing conditions or medical care provided by external healthcare providers.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or matters where liability cannot be lawfully limited.
12. Website Use
Our website is provided for informational purposes and to facilitate inquiries about our services. You may use the website for lawful purposes only.
You agree not to:
- Use the website in any way that violates Thai laws or regulations
- Attempt to gain unauthorized access to the website or its systems
- Transmit malicious code, viruses, or harmful content
- Use automated systems to access or collect information from the website
- Misrepresent your identity or affiliation when using the website
We reserve the right to suspend or terminate website access for violations of these terms.
13. Intellectual Property
All content on the Dewfall website, including text, images, logos, design elements, and software, is owned by Dewfall or licensed to us. This content is protected by Thai and international copyright and trademark laws.
You may view and print website content for personal, non-commercial use. You may not modify, reproduce, distribute, or create derivative works without our written permission.
The Dewfall name and logo are our trademarks and may not be used without authorization.
14. Dispute Resolution

If informal resolution is unsuccessful, disputes shall be resolved through mediation or arbitration in accordance with Thai law before resorting to litigation.
These Terms and Conditions are governed by the laws of Thailand. Any legal proceedings must be brought in the courts of Songkhla Province, Thailand, and you consent to the exclusive jurisdiction of these courts.
15. Force Majeure
We shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, public health emergencies, wars, civil unrest, or utility failures.
During force majeure events, we will make reasonable efforts to continue providing services and will communicate with residents and families about temporary modifications or alternative arrangements.
16. Changes to Terms
We may update these Terms and Conditions periodically to reflect changes in our services, legal requirements, or operational practices. Significant changes will be communicated through our website and, for existing residents, through direct notification.
For website users, continued use after changes constitutes acceptance of modified terms. For residents, changes to terms affecting residency agreements require written consent or agreement renewal.
The "Last Updated" date indicates when the most recent revision occurred.
17. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any residency agreement, constitute the entire agreement between you and Dewfall regarding use of our website and services. They supersede all prior communications and agreements.
